{"id":3324,"date":"2022-01-17T09:53:02","date_gmt":"2022-01-17T09:53:02","guid":{"rendered":"https:\/\/icamek.org\/?page_id=3324"},"modified":"2022-01-19T19:31:17","modified_gmt":"2022-01-19T19:31:17","slug":"med-arb-clause","status":"publish","type":"page","link":"https:\/\/icamek.org\/index.php\/med-arb-clause\/","title":{"rendered":"Med-Arb Clause"},"content":{"rendered":"<p>[vc_row css=&#8221;.vc_custom_1642620074644{padding-top: 107px !important;padding-bottom: 130px !important;}&#8221;][vc_column][vc_column_text]<!-- <i><span style=\"font-weight: 400;\">Any dispute arising out of or in relation to any issue regarding the interpretation, performance, breach, termination, validity or invalidity of this contract, shall be submitted for mediation administered by ICAMEK in accordance with ICAMEK Mediation Rules inforce on the date when the request for mediation is submitted.<\/span><\/i>\n\n<i><span style=\"font-weight: 400;\">If an agreement has not been reached or the dispute is not resolved by mediation within 60 days from the day it is submitted, either party may refer the dispute to be finally resolved by Arbitration administered by ICAMEK in accordance with the ICAMEK Arbitration Rules inforce on the date when the request for arbitration is submitted.<\/span><\/i>\n\n\n<ul>\n \t\n\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The number of arbitrators shall be\u2026 (one or three);<\/span><\/i><\/li>\n\n\n<\/ul>\n\n\n\n\n<ul>\n \t\n\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The seat or legal place of arbitration shall be\u2026 (town and country);<\/span><\/i><\/li>\n\n\n \t\n\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The language to be used in the arbitral proceedings shall be<\/span><\/i><\/li>\n\n\n<\/ul>\n\n\n<i><span style=\"font-weight: 400;\">Each of the steps foreseen in this provision is a condition precedent to proceed with the following step, unless the terms have expired.<\/span><\/i> --><\/p>\n<p><em>\u201cIn the event of a dispute, controversy of claim arising out of in connection to this contract, the parties shall first refer the dispute to proceedings under the ICAMEK(Mediation) Rules.
